Terms of Service

These Terms of Service (“Terms”) govern your use of dusklight.digital (the “Site”), operated by Dusklight Digital (“Dusklight Digital,” “we,” “us,” or “our”). Please also review our Privacy Policy, which explains how we handle information.
Acceptance of these terms
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
What the Site is
The Site is an informational and marketing website. It describes our web design and digital services — including websites, SEO, Google Business Profile setup, maintenance and hosting, and automations — and lets you contact us. Using the Site does not create a client relationship or obligate us to provide services.
Quotes, proposals, and pricing
Any prices, packages, timelines, or examples shown on the Site are general information and estimates. They are not offers and are not binding. Project pricing and scope are confirmed only in a separate written agreement or proposal signed by both you and Dusklight Digital. If anything in that signed agreement conflicts with these Terms, the signed agreement controls for that project.
Payment, deposits, and refunds
When we agree to a project, the following applies unless your signed agreement says otherwise:
- A deposit of 50% of the project total is due before work begins, and that deposit is non-refundable.
- The remaining balance is due as set out in your agreement or invoice.
- If an invoice is unpaid, work on your project stops until the balance is brought current, and timelines may shift as a result.
Invoices are paid through secure, Stripe-hosted payment pages. Payment card details are handled by Stripe, not by the Site.
Intellectual property
All content on the Site — including text, design, graphics, logos, and code — is owned by Dusklight Digital or its licensors and is protected by intellectual property laws. You may not copy, reproduce, republish, or reuse Site content without our written permission. The “Dusklight Digital” name and brand are ours.
Ownership of work we create for a client is addressed in that client’s separate signed agreement, not by these Terms.
Acceptable use
When using the Site, you agree not to:
- Use it for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site or its systems
- Interfere with or disrupt the Site’s operation or security
- Copy, scrape, or harvest content or data except as normally allowed for personal, non-commercial browsing
- Submit false information or use the contact form to send spam or malicious content
Links to other sites
The Site may link to third-party websites and services, including payment pages. We provide these links for convenience and do not control or endorse those sites. We are not responsible for their content, availability, or practices. Your use of a third-party site is governed by that site’s own terms and policies.
Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.
Limitation of liability
To the fullest extent permitted by law, Dusklight Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to indemnify and hold harmless Dusklight Digital and its owner from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in Tennessee, and you consent to their jurisdiction.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and post the new version on this page. Your continued use of the Site after changes take effect means you accept the updated Terms.
